Litigation, Enforcement and Cooperation with Attorneys from Abroad for Cases Related to Turkey

During my stay in Germany for getting my PhD Degree, I met colleagues from all around the world, who were working as lawyer or attorney in their countries, with whom I am currently cooperating. There is always a discussion about how to determine the legal fees, if the case has an international relation. 

In Turkey lawyers are usually working on task basis. The amount of agreed fee is being paid half or full before starting with the tasks. Cases, which are being held by the criminal courts are mostly this kind of cases. As a defence attorney it is important to be paid, before authorised to act. As a lawyer for civil cases or for victims right in criminal cases it is also the same.

There are some cases where the job to be done is not so complicated. For those cases lawyers are working mostly on an hourly determined basis fee. Like getting a document from a Turkish authority.

But there are some cases like, finding out heirs in Turkey from decedent, who’s children having their domicile in Turkey. For example, the decedent has left surviving the Turkish citizens children who would inherit his/her estate pursuant. For this cases it is usually to work on hourly basis, but it is also possible to work on contingency basis too. Especially in cases in which colleague from abroad are working on contingency basis, it is only fair to do so. Last but not least attorneys in Turkey can agree on a conditional fee too. Which is being paid depending on the amount of the case (the value of the litigation) in percentage.

We operate on hourly basis, task based and or contingency basis. It depends on the case and tasks to be done.
